A Warren LLP team led by Matt Warren secured complete dismissal of Wolverine Barcode's claims against Albertsons in the Northern District of Texas under 35 U.S.C. § 101.

In Wolverine Barcode IP LLC v. Albertsons Companies, Inc., the court concluded that the asserted patent was directed to the abstract idea of customer accounts and lacked the inventive concept required for patent eligibility under the Supreme Court's Alice framework. The court further denied the plaintiff leave to amend their complaint, finding that it would be futile.

Wolverine Barcode has filed numerous other cases asserting the same patent, but Warren LLP's victory will impair any continued enforcement efforts.
